Further information
Commission Regulation No 944/2013 reclassifies “Pitch, coal tar, high temp. (CAS65996-93-2)” effective 1 April 2016. Scientific information supports H413 instead of H400 and H410. Industry therefore applied for annulment. The General Court Luxembourg ruled in favour of industry (Case T-689/13). The commission filed an Appeal in December 2015. Usually lodging an Appeal has no suspensory effect. However, when a regulation (or part of it) is declared to be void by the General Court, the Commission’s Appeal has suspending power.
